  The personal attention of all the District Medical and Health Officers, is  invited to the references 1 and 3 cited, and they have been requested to implement the judgement of the Hon’ble High Court Dated.11-9-2003 in W.P.No.15107/2002 and batch cases. The direction of the Hon’ble high Court in W.P.No.15107/2002 which is upheld by the Hon’ble Supreme Court dated.9-8-2011 in  civil Appeal No.4267/2006 is as follows.

“All the interim orders in the Batch of Writ Petitions ceased to have any effect.consequently we direct the state Government to prepare the select list of  candidates in accordance with rules who possessed SSC and Diploma certificate either from Government institutions or the four private institutions referred to  supra including College of Medical Technology, Ongole. As the cancellation of  recognition of the said college was effected on 5-7-2002 which is the subject matter in separate Writ Petitions.However if any selected candidate from those  institutions  is holding certificate issued on 5-7-2002 or thereafter it shall not be given effect to .The candidates so selected shall be issued with the appointment orders within a period of four weeks from today duly terminating the services of the  candidates who were appointed on the basis of interim orders and not figuring in the select list prepared under this order.

 Further the  District Medical and Health Officers are informed that Government vide memo 4th cited, have instructed to examine the orders of Hon’ble APAT in O.A.No.2245/2012 and various other O.A’s in which Hon’ble APAT have suspended the items of 1(b),4,14 &15 issued vide Govt.Memo.No.3rd cited, and to take necessary action as per rules inforce from time to time copy of Govt.Memo enclosed herewith.

In view of the above the District Medical and Health Officers are requested to take necessary action interms of G.o.1st cited, and clarificatory Memo.3rd cited. In all Court cases by filing V.M.A’s and issuing speaking orders to the applicants wherever necessary.

Hence, they are requested to complete the process by 9-4-2012 without waiting for further clarification as there is a contempt case in C.C.No.43/2012 in W.P.No.422/2003 is pending before Hon’ble High Court.

This should be treated as Most urgent.
